Is CBD Legal? The Farm Bill & the 0.3% Rule
Hemp-derived CBD was federally authorized by the 2018 Farm Bill, provided it contains no more than 0.3% Delta-9 THC by dry weight. This guide from Solverra Holistics explains what that means, how hemp differs from marijuana, and why state rules still vary. This is general information, not legal advice.
The federal rule
What the 2018 Farm Bill changed
The Agriculture Improvement Act of 2018, widely called the 2018 Farm Bill, removed hemp and hemp-derived compounds from the federal Controlled Substances Act. The law defines hemp as cannabis containing no more than 0.3% Delta-9 THC by dry weight. Cannabis above that threshold is classified as marijuana and is regulated differently at the federal level.
Because of this rule, hemp-derived CBD that stays under the 0.3% Delta-9 THC limit is federally lawful to produce and sell when it meets applicable requirements. Every Solverra hemp product documents that it stays under this threshold on its third-party Certificate of Analysis.
Hemp vs marijuana
The 0.3% line
| Aspect | Hemp | Marijuana |
|---|---|---|
| Delta-9 THC by dry weight | 0.3% or less | More than 0.3% |
| Federal status | Removed from Controlled Substances Act (2018 Farm Bill) | Federally controlled |
| Intoxicating | No, at compliant levels | Yes |
| Source of Solverra CBD | Yes | No |
State variation
Why state rules still matter
Federal authorization is only part of the picture. States set their own rules, and some restrict specific hemp product categories, cannabinoid types, or shipping into the state. A product that is federally compliant may still be limited by where you live or where it is being shipped. This is why a responsible retailer applies state-specific rules at checkout rather than assuming one nationwide standard.
Solverra maintains state shipping restrictions and applies them during checkout so orders align with the destination’s rules. Because state law changes over time, treat this page as a general overview and confirm the current rules for your state. This is not legal advice.
Verify compliance
How to confirm a product is compliant
Read the COA
Confirm the Certificate of Analysis shows Delta-9 THC at or under 0.3% for the batch you are buying.
Confirm hemp-derived
The product should state it is hemp-derived, not marijuana-derived.
Know your state
Verify your state allows the specific product and that shipping is permitted to your address.
